BME/World Services and Terms of Membership

This Agreement provides the terms and conditions governing the use of Membership service on the BME/World Web Site (www.BMEworld.com/), hereafter referred to as the "Site." Membership on the Site provides registered Members (each a "Member") with a package of content and services. BME may, at its discretion, add or delete features. By registering as a Member, you agree to use the Site in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions discussed below.

1. Price

BME/World membership and services are free.

2. Terms of Membership

Membership is available to any body modification fan and supporter who registers all required information, provides an accurate and legitimate contact address and phone number, and obtains a BME/World member name and password. Each member is allowed one account. Accounts are non-transferable and for personal use only. Any exceptions must be approved by BME.

3. Web Page Guidelines

BME/World is not responsible for the content of any personal homepage, and the views expressed in the membership area of BME/World are the responsibility of the posting member, and not of BME/World. BME/World does not review member web pages in any way before posting. BME/World reserves the right to remove any page from the Site. BME/World footers must be include on all personal web pages, and failure to do so is grounds for removal of the web page and termination of BME/World membership.

BME/World provides web space but makes no implied or express warranties about the reliability of these pages. BME/World is not responsible for any damage caused by loss of access to, or deletion or alteration of Member pages; individual Members are responsible for monitoring and creating backups of their pages.

BME/World pages must be body modification related.

The following is a non-exclusive list of actions and content that are not permitted on the Site:

• Any use of copyrighted material without the express permission of the author or owner.
• Pages that exploit the images of children under 18 years of age.
• Material that is grossly offensive to the BME/World Community, including clear expressions of bigotry, racism, or hatred.
• Pages that promote illegal, non-body modification activity (pages promoting consensual body modification of questionable legality are acceptable).
• Material that defames, abuses or threatens others.
• Pages that contains material inconsistent with the values of the spirit of the BME/World Community.
• Use of a Member Web page as storage for remote loading.
• Use of Member Web pages for commercial pages, including but not limited to:
  • Offering for sale products or services.
  • Soliciting for advertisors or sponsors.
  • Displaying sponsorship banners of any kind, other than the one included in the BME/World footer.
  • Promoting any multi-level marketing or pyramid schemes.
  • Conducting raffles or contests that require any entry fee.
  Note: Pages for body-art related businesses are allowed, but do realize that you will have ads for your potential competitors placed on your page via rotating banners -- separate hosting is available.

4. Use of BME/World email

BME/World email accounts may not be used for:

• Transfer of copyrighted material without the express permission of the author or owner.
• Transfer of non-body modification related binaries.
• Sending unsolicited email, spamming to newsgroups or to internet search engines.
• Harassing or threatening anyone.

5. Privacy

All information provided by a Member is stricly confidential. BME/World will not release member information without the permission of that member.

In the event of Police or legal investigation Member information may need to be released. Members are encouraged to use encryption such as PGP.

6. Adult Content

Adult and pornographic material is acceptable if it is relevant to the body modification spirit of this server. However, if a BME/World site starts to take up overly large amounts of bandwidth actions may be taken to reduce that bandwidth up to and including removal of the site as a last resort.

7. Limitations of Liability or Warranty

The Member agrees that the use of the Site is entirely at the Member's own risk. The Site is provided on an "as is" basis without warranties of any kind, either expressed or implied. Furthermore, neither BME nor any third-party content provider makes any warranty with respect to any content, information, services, or products provided through or in conjunction with the Site.

The Member specifically agrees that BME or third-party content providers are not liable for any conduct by Members associated with the Site, including, but not limited to, Member Web pages, chatrooms, or emails.

BME and third-party content providers make no guarantee of the accuracy, correctness, or completeness of any information on the Site and are not responsible for (i) any errors or omissions arising from the use of such information; (ii) any failures, delays, or interruptions in the delivery of any content or services contained within the Site; or (iii) losses or damages arising from the use of the content or services provided by the Site.

8. Indemnity

A Member agrees to indemnify BME and any third-party information provider against any and all claims and expenses, including attorneys' fees, arising from the Member's use of the Site. This expressly includes: (i) Member's responsibility for any and all liability arising from the violation or infringement of proprietary rights or copyrights and (ii) any libelous or unlawful material contained within Member Web pages or Postings.

9. Termination of Service

BME/World may terminate Membership and any and all information, communications, Postings, or Web pages at any time, without notice, for conduct that violates this Agreement or other policies or guidelines set out by BME/World elsewhere on the Site. BME/World may terminate Membership and delete any and all information, communications, Postings, or Web pages for online conduct that BME believes is harmful to other Members, the business of BME/World, or other third-party information providers.
